Terms and Conditions of Sale

Article 1 - Purpose

These General Terms and Conditions of Sale govern the contractual relations between Autoluxary and any natural or legal person purchasing a new electric vehicle via the autoluxary.store website or directly in the showroom.

Article 2 - Products

The vehicles offered for sale are new electric vehicles, compliant with current European standards. The technical characteristics, equipment, and options are those described in the product sheet at the time of ordering. Photos and visuals are provided for illustrative purposes. Prices are indicated in euros (€), all taxes included (VAT).

Article 3 - Order

Any order is firm and definitive after:

  1. Acceptance of these Terms and Conditions
  2. Payment of a deposit of 30% of the total price including tax of the vehicle
  3. Receipt by Autoluxary of a complete file comprising the supporting documents (identity document, proof of residence, driving license)

The order is confirmed by sending a summary email to the address provided by the customer. Autoluxary reserves the right to refuse any order in the event of an incomplete file or suspicion of fraud.

Article 4 - Prices and payment terms

Prices are firm and non-revisable. Payment is made according to the following terms:

  • Deposit: 30% of the price including tax at the time of ordering, by bank transfer or credit card
  • Balance: remaining 70% to be paid no later than the day of delivery

Financing solutions (classic loan, lease with option to purchase) are available from our banking partners. The detailed conditions are communicated upon request.

Article 5 - Delivery times

Delivery times are indicated on each product sheet and vary depending on the model, configuration, and manufacturer availability. On average:

  • Vehicles in stock: 7 to 15 business days
  • Vehicles ordered from the factory: 2 to 4 weeks

Autoluxary undertakes to inform the customer of the progress of their order at each key stage (manufacturer confirmation, production, transport, arrival at the showroom). Delivery delays attributable to the manufacturer shall not render Autoluxary liable and shall not give rise to late-delivery penalties, unless otherwise agreed.

Article 6 - Delivery and acceptance

Delivery takes place at the Autoluxary showroom or at home (as an option, depending on geographic area). On the day of delivery, the customer proceeds with the inspection of the vehicle in the presence of an Autoluxary advisor:

  • Exterior and interior visual inspection
  • Verification of the equipment and options ordered
  • Start-up test and presentation of the features
  • Delivery of documents (temporary registration certificate, manual, certificate of conformity)

Any reservation must be mentioned on the delivery note. Signing the delivery note constitutes acceptance of the vehicle.

Article 7 - Warranties

All vehicles benefit from the manufacturer's warranty:

  • Vehicle warranty: 3 to 6 years or 100,000 to 150,000 km depending on the brand (whichever comes first)
  • Battery warranty: 8 years or 250,000 km (European legal minimum)
  • Anti-corrosion warranty: 6 to 12 years depending on the manufacturer

The detailed conditions of each warranty are specified in the vehicle's maintenance booklet.

Article 8 - Right of withdrawal

In accordance with article L.221-18 of the Consumer Code, the customer has a period of 14 days from delivery to exercise their right of withdrawal. Return costs are borne by the customer. The vehicle must be returned in its original condition, with mileage not exceeding 1000 km.

Article 9 - After-sales service

Autoluxary has a dedicated after-sales service reachable at contact@autoluxary.store or at +1(587)209-3825. Warranty interventions are carried out in our network of approved partner garages.

Article 10 - Mediation

In the event of a dispute, the customer may resort free of charge to the consumer mediator: CM2C, - www.cm2c.net.

Article 11 - Applicable law

These Terms and Conditions are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Paris.
